Welcome to Tab Seven. These Terms & Conditions ("Terms") govern your access to our website and your use of our IT services (collectively, the "Services"). By accessing our website or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. ACCEPTANCE OF TERMS

By using our website or entering into a project with Tab Seven, you confirm that you are at least 18 years of age and have the authority to enter into a binding agreement on behalf of yourself or your business.

2. DESCRIPTION OF SERVICES

Tab Seven provides IT solutions, including but not limited to:

  • Website, e-commerce, and mobile app design and development.
  • Custom software, ERP, CRM, and system integrations.
  • Cloud hosting, DevOps, and ongoing maintenance and support.
  • AI chatbots, assistants, and business process automation.

The specific scope, deliverables, timeline, and fees for each project will be set out in a written proposal, quotation, or agreement ("Project Agreement"). If a Project Agreement conflicts with these Terms, the Project Agreement will prevail.

3. CLIENT RESPONSIBILITIES

3.1 Information and Access

You agree to provide accurate information, content, feedback, and any system access we need to deliver the Services in a timely manner. Delays in providing these may affect project timelines.

3.2 Account Security

You are responsible for keeping any login credentials we provide confidential, and for notifying us immediately of any unauthorised access.

4. INTELLECTUAL PROPERTY RIGHTS

4.1 Ownership of Deliverables

Upon full payment, you own the custom code, designs, and content created specifically for your project, unless otherwise stated in your Project Agreement.

4.2 Third-Party and Pre-Existing Components

Deliverables may include open-source software, third-party licences, plugins, or our own pre-existing tools and libraries. These remain subject to their respective licences, and we grant you the right to use them as part of your project.

4.3 Our Website

The content, branding, and design of the Tab Seven website remain our exclusive property and are protected by copyright and trademark laws.

5. ACCEPTABLE USE

You agree not to use our website or Services for any unlawful purpose, including:

  1. Illegal Content: Creating or distributing content that is unlawful, defamatory, or harmful.
  2. Infringement: Violating the intellectual property rights of others.
  3. Malware: Uploading viruses or malicious code.
  4. Unauthorised Access: Attempting to access systems or data without permission.
  5. Automated Scraping: Using bots or scripts to scrape our website without authorisation.

6. FEES AND PAYMENTS

6.1 Project Fees

Fees for projects and maintenance plans are set out in your Project Agreement or quotation. Unless agreed otherwise, invoices are payable within the period stated on the invoice, and applicable taxes are charged in addition.

6.2 Refunds

Payments for work already completed are non-refundable, except as required by law or agreed in writing. Monthly plans can be cancelled in line with the notice period in your agreement.

7. WARRANTY AND SUPPORT

We will deliver the Services with reasonable skill and care. Any defects reported within the warranty period stated in your Project Agreement will be fixed at no additional cost. Ongoing updates and new features are covered by our maintenance plans.

8. TERMINATION

Either party may terminate a project or plan in accordance with the Project Agreement. We may suspend access to our Services if invoices remain unpaid or these Terms are breached.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Tab Seven, its directors, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising from:

  • Your use of, or inability to use, the Services.
  • Third-party services, hosting providers, or integrations.
  • Unauthorised access to or alteration of your data or systems.

Our total liability for any claim shall not exceed the fees paid by you for the specific Service giving rise to the claim.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. PRIVACY POLICY

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use personal information.

12. MODIFICATIONS TO TERMS

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date.
